Physical Presence and Advance Parole

 

            Lastly, for all the people that are currently in the country and are going to file an Adjustment… there is another law that involves something called Physical Presence.  Basically, you must show that you were here, physically present, in the USA on or before 12/20/2000 in addition to all the above proof.  

            If you have been here illegally many years and you apply for Adjustment you are not eligible to travel with Advance Parole. The USCIS may send it if you request it but

you will be subject to a 10 year bar nonetheless. Do not travel before the Permanent Residency approval.

            We at Immigration Advocacy Services, a Not-for Profit CBO, are writing this article so that you can understand that regardless of what anyone promises you, you cannot get a Green Card or permanent residency with just an approved I-130.  Be careful of unscrupulous practitioners who will promise just that. Always get a second opinion.
